These Terms of Use (“Terms”) govern your use of Trinh Pham’s iOS apps and related services (the “Services”). If you do not agree to these Terms, do not use the Services.

By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms and any applicable laws and regulations.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to these Terms and any applicable App Store rules.

Restrictions

You agree not to:

• Use the Services in any way that violates applicable law or infringes any rights.
• Attempt to gain unauthorized access to the Services or related systems.
• Interfere with or disrupt the operation or security of the Services.
• Reverse engineer, decompile, disassemble, or attempt to derive source code, except where prohibited by law.

Intellectual Property

The Services, including all content, design, software, and trademarks, are owned by Trinh Pham or licensors and are protected by intellectual property laws. Except for the license granted above, no rights are granted to you.

Third-Party Materials and Apple

The Services may display or rely on features provided by Apple’s platforms and APIs. Apple is not responsible for the Services, and Apple has no obligation to provide maintenance or support for them. If you access the Services through Apple’s App Store, you also agree to comply with Apple’s applicable terms and policies.

Disclaimer

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Trinh Pham will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services.

To the maximum extent permitted by law, Trinh Pham’s total liability for any claim arising out of or relating to the Services will not exceed the amount you paid (if any) for the app or service giving rise to the claim.

Termination

We may suspend or terminate access to the Services at any time if we reasonably believe you have violated these Terms or if needed to protect the Services, users, or rights. You may stop using the Services at any time by uninstalling the app(s).

Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page. Your continued use of the Services after changes become effective means you accept the updated Terms.

Governing Law

These Terms are governed by applicable laws determined by the place of operation of the developer, without regard to conflict of law principles, except where mandatory local consumer laws apply.
